Sub : Abusive Facebook post maligning Brahmin Community, Hindu Religion, BJP (Political Party) and RSS (Rashtreeya Swayamsevak Sangh) by Mr. Abhilash Thiruvoth and Mr. Karayi Rajan.

This is to bring your kind attention on a serious issue which attracts severe punishment under respective sections concerned.

On 6th of July 2023, Mr Abhilash Thiruvoth,
(Abhilash TK), S/o Kunjiraman T , Thiruvoth house, Perambra PO, Kozhikode - 673525 and Mr. Karayi Rajan, S/o Pokkan, Thazhathuputhiya Veedu, Pullyode, Kadiroor PO, Thalassery - 670642 posted a malicious content on their Facebook ID which is in-fact an act punishable under IPC 153, 153A, 295A, 504. Mr Abhilash is the original content creator or artist who made the artistic representation which abuses Hinduism, Brahmin Community and political party BJP as well.

Mr. Abhilash who is spreading these hatred art is a Govt school teacher which is another matter of concern.

The facebook post is related to the unfortunate issue happened un Madhya Pradesh where a man urinated on another dalit man. The MP state has taken severe action against the culprit with appropriate sections under IPC. But the captioned posts related to the same issue from the aforesaid two FB profiles are very offensive, misinformative and with an intention of creating enmity between two communities or castes and as well as maligning a reputed organisation which rules the country.

Infact Shukla name is redefined as Semen - Male Reproductive Fluid as an abuse to the entire Shukla Hindu Community, Hindu religion and Brahmin community as well without any sort of provocation from any of these communities or persons representing these communities.

Facts :
Pravesh Shukla is not BJP leader.
The shameless act by a person with insane mind has nothing to do with Brahmin Community nor with Hindu religion as mentioned in the post. This accusation is punishable under relevant sections of IPC.

The facebook post of both the persons mentioned above attracts the following sections of IPC and deserve punishment.
Section 153 of the Indian Penal Code, 1860 which refers to the offence done malignantly or wantonly to give provocation to the extent of causing a riot, Sections 153 A (promoting enmity between different groups on grounds of religion, race, place of birth, residence, language etc.), Section 292 IPC distributes osbcene material, Section 294 IPC prohibits obscene acts Section 505 (2) (statements conducing to public mischief), 295A IPC Deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs Section 66 of the IT Act, Section 67 - Punishment for publishing or transmitting obscene material in electronic form, Section 67A - Punishment for publishing or transmitting of material containing sexually explicit act, etc., in electronic form.
